These General Terms and Conditions (hereinafter referred to as the GTC) set out the general conditions for participation of webshop users, ticket buyers (hereinafter: Customers) and visitors (hereinafter: Visitors) at the festival (hereinafter: Event) organised and held by Klein Csaba E.V. (registered office: 1038 BUDAPEST, Újliget sétány 3.) (hereinafter: NOMAD Gathering), and the rights and obligations arising from the legal relationships between NOMAD Gathering and the Visitors (hereinafter collectively: Contracting Parties).
The provisions of these GTC apply in all cases to participation in the Event and to the legal relationship between NOMAD Gathering and the Visitors. NOMAD Gathering publishes the present GTC on its website, and at the time of the online ticket purchase that creates the contractual relationship, it makes them available at its registered office and at the entry points to the Event in printed form, readable on site.
Definitions
Event: a festival of any theme organised by NOMAD Gathering, but generally musical.
Festival: a multi-day music and entertainment event with programmes and other services organised annually by NOMAD Gathering at a specific time and place.
Customer: the natural or legal person who purchases a ticket for a given Event either online as a user or in person at the venue or sales points.
Visitor: a natural person who is entitled to enter and participates in a given Event.
Service: any service that NOMAD Gathering or its contractual partners make available to Visitors at the Event, either free of charge or for a fee.
Webshop: operates an online ticketing system to facilitate the purchase of entry tickets exclusively for its own various Events.
Ticket: proof issued during ticket purchase entitling participation in an Event organised by NOMAD Gathering (whether free or for a fee), which may be a pass/student pass, e-ticket, day ticket, admission ticket, complimentary ticket, etc. (a uniquely identifiable, numbered voucher);
House Rules: a document containing specific mandatory provisions applicable to each Event, established with regard to the circumstances of the given Event, which includes the own rules of the area/room/company hosting the Event and is available on the NOMAD Gathering or hosting company's website, and available for inspection at the Event venue upon request.
2. SCOPE OF THE GTC
2.1. This GTC is valid for an indefinite period.
2.2. The Visitor acknowledges that NOMAD Gathering is entitled to unilaterally amend this GTC, with notification of the persons concerned, accompanied by a public notice. The amendments take effect immediately upon publication on NOMAD Gathering’s website. If the amendment affects the legal relationship under clause 4.2 (i.e. not only the ticket purchase process under clause 5), the Visitor shall be entitled to withdraw from the present legal relationship in writing, without giving reasons, for fourteen days from that time, provided that they have not yet commenced their visit to the Event. The Visitor shall not have a right of withdrawal if the amendment contains only provisions that are more favourable for the Visitors.
3. CONTRACTUAL RELATIONSHIP
3.1. Upon payment of the price of the Ticket and delivery of the Ticket by NOMAD Gathering, the Parties enter into a contractual relationship with each other. NOMAD Gathering provides the Visitor with the opportunity to participate in the given Event.
The entry ticket constitutes a civil law contract between the Customer and Csaba Klein, sole proprietor. The Event organiser regards the purchase of the entry ticket as a legal declaration recognising the rules for using the service covered by these GTC.
Tickets are personal and, as a general rule, are non-transferable.
The ticket is protected with a unique code and its authenticity is checked upon entry. The barcode reader system cannot distinguish copied Tickets from each other, therefore the Event organiser will always accept the FIRST scanned electronic Ticket as genuine. Any additional electronic ticket with the same barcode is considered a copy, i.e. an invalid ticket, and entry will be refused.
NOMAD Gathering is unable to replace or exchange lost, destroyed or damaged tickets.
In connection with the online purchase of a ticket, the organiser handles the data that have come into its possession and are necessary for the electronic issuance of the ticket solely for the purpose indicated here; it may not disclose such data to any third party — except where required by law or authority — and will store them only for the period necessary for the organisation and administration of the present Event.
If the Event is cancelled, details of ticket refunds can be found on the Event website. In the event of cancellation, the organiser will not refund or compensate any claim beyond the price of the ticket.
Except in the case that the Event is cancelled, the organiser does not exchange or refund tickets.
3.5. The content and quantity of the specific programmes and Services available at the Events are determined by NOMAD Gathering as organiser and promoter, but it does not guarantee their content, quality or quantity (for example the performance of a particular performer) to the Visitor and reserves the right to change the programme. Nevertheless, NOMAD Gathering always endeavours to provide the programmes and Services previously communicated, or to replace previously communicated and cancelled programmes with a programme of similar standard.
The Event organiser reserves the right to change the date and location and accepts no liability for any presumed damages arising from such changes.
4. TICKET, TICKET PURCHASE, ENTRY
4.1. The ticket price categories can be found on the NOMAD Gathering website.
4.2. Purchasing tickets electronically
NOMAD Gathering’s own website offers convenient and secure online payment provided by OTP Mobil Services Ltd. (1093 Budapest, Közraktár 30‑32) via the SimplePay system. The general terms and conditions and the privacy policy of OTP Mobil Services Ltd. are continuously available at https://simple.hu/aff, which NOMAD Gathering and the Customer have read and accepted.
The Customer’s bank card details do not reach NOMAD Gathering. When paying by card, the Customer is redirected to the payment system page, so payment takes place directly on the page operated by them in accordance with the rules and security requirements of international card companies and not on the NOMAD Gathering site. NOMAD Gathering does not possess or have access in any form to the Customer’s card or the associated account details, number or expiry date.
If the Visitor purchases through the NOMAD Gathering website, after providing the necessary data and successful financial completion, NOMAD Gathering will email the Customer’s ticket in .pdf format to the email address provided during the order. The Customer must present the voucher either printed out or on an appropriate electronic device (phone, iPad, tablet, laptop) upon entry to the Event, on the basis of which they will receive the wristband entitling them to enter at the entrance gate.
4.3. Purchasing a ticket in person
NOMAD Gathering only offers the possibility to purchase tickets in person at the festival site during the festival period.
4.4. Wristband
After entry, the wristband embodies the rights and obligations associated with the ticket; NOMAD Gathering and its cooperating partners (security personnel) are entitled to check its integrity and that it is being worn at the entrance gates and throughout the Event area. Persons present at the Event site without authorisation must leave the venue immediately. A damaged wristband is invalid; NOMAD Gathering does not replace wristbands that are damaged, lost or tampered with in any way.
5. RULES OF CONDUCT
5.1. Visitors are required to observe general norms of conduct within the Event area and to behave in accordance with these GTC and the House Rules of our hosts at any given time, and to refrain from any expression or action that may infringe or endanger the personal rights, health, physical integrity or life of others, or hinder or disturb the purpose, entertainment or relaxation of Visitors to the Event. In view of the nature of the NOMAD Gathering Event, the Visitor shall pay particular attention to the protection of natural values both at the Event site and in its surroundings.
5.2. Without the prior written permission of NOMAD Gathering, any promotional or advertising activity, commercial or economic activity, or fundraising at the Event site is prohibited.
5.3. Serving alcoholic beverages to persons under 18 and intoxicated persons is prohibited on the Event site. Persons selling in commercial and catering units are entitled to call upon the Visitor to present personal documents suitable for verifying age. The consumption of substances classed as narcotics is prohibited on the Event site and is punishable by law.
5.4. Without prior written permission from NOMAD Gathering, it is prohibited to organise or hold any gathering or demonstration outside the organised programmes and unrelated to them. NOMAD Gathering is entitled to have such a gathering stopped immediately and, after being asked, to have those participants who do not suspend this activity upon the request of NOMAD Gathering or its cooperating partners (security personnel) escorted from the Event.
5.5. Within the Event area, NOMAD Gathering’s qualified and licensed collaborators ensure the enforcement and compliance of behavioural and safety rules. The Visitor undertakes to cooperate fully with these professionals and to follow their instructions immediately in the event of a danger situation.
6. AUDIO AND IMAGE RECORDING
6.1. The Visitor acknowledges that NOMAD Gathering may make image and sound recordings of the event, as may its commissioned contractual partners, cooperating partners, other Visitors and third parties. Accordingly, the Visitor gives their express consent to the recording and publication of their face, appearance and utterances, with the proviso that they may only be named with their express consent. An exception to this is if the person is a public figure, in which case they may be named without their consent.
6.2. In respect of the above appearances, the person who creates them is entitled to use and exploit the depiction of the Visitor without restriction (promoting the Event, reproduction, publication, adaptation, disclosure, communication to the public – online and offline, for simultaneous and later use, etc.), without having to provide any form of remuneration to the Visitor. The Visitor is not entitled to assert any claim or demand against NOMAD Gathering in connection with the above.
6.3. The Visitor is entitled to make image and sound recordings at the Event, with the proviso that the Visitor may not sell the image and sound recording they have made or exploit it for consideration (and not even for commercial purposes without consideration). Visitors appearing in the recordings may not be named without their express consent, and their personality rights may not be infringed. NOMAD Gathering expressly excludes its liability in the event that Visitors do not comply with the provisions of this Section 6.
7. FIRST AID, MEDICAL SERVICE
A 24-hour medical service is provided at a designated place at the Event site. The Visitor is entitled to use this service under valid social security, health or travel insurance. If they do not have any of the above, they are entitled to use the service for a fee.
8. HOUSE RULES
NOMAD Gathering makes the House Rules of the Event venue available on its website, and provides an opportunity to inspect them at the Event entrance gates upon request. In addition to the provisions of these GTC, the Visitor is obliged to fully comply with the rules and provisions contained in the House Rules.
9. LIABILITY
9.1. NOMAD Gathering reserves the right to modify or adapt the concerts, programmes and services provided at the Event if necessary. The Visitor is not entitled to object in the event of a programme change.
9.2. The Visitor is aware that not all services at the Event are provided by NOMAD Gathering; in the case of certain services, the legal relationship is created directly between the Visitor and the Collaborator, and the rights and obligations arising from the legal relationship belong to and burden them. NOMAD Gathering accepts no responsibility for the products and services provided by its contractual partners.
9.3. NOMAD Gathering accepts no responsibility for items left unattended within the Event area, including items left in tents or cars.
9.4. The Visitor declares that the data provided by them during ticket purchase are accurate. NOMAD Gathering does not accept liability for any damage resulting from the inaccurate provision of data.
9.5. The Visitor acknowledges that NOMAD Gathering cannot be held responsible for any misuse or damage arising during any payment method (e.g. unauthorised use of bank cards, unauthorised transfers, etc.).
9.6. The Visitor is fully liable (both civilly and criminally) for any damage caused by them (their child or pet) in respect of NOMAD Gathering, the Venue, its contractual partners, collaborators, other visitors and third parties. During the event, by entering the event the Visitor unconditionally accepts liability for damages caused culpably.
9.7. The organiser of the NOMAD Gathering Festival can only be held liable within the framework of the laws in force during the Event and the provisions set out in the GTC relating to event services. Beyond this scope of liability, in the case of any damage event caused by any third party (Visitor, partner, non-own staff, etc.), regardless of culpability, the liability for damages is transferred directly to the person causing the damage; every person present during the Event and on its site acknowledges and accepts this personal liability as binding upon entry.
10. COPYRIGHTS AND TRADEMARKS
10.1. The logos, trademarks, information and materials appearing on NOMAD Gathering’s website, Facebook page, at the Events, in all online and offline media, as well as on posters, flyers, etc., are the exclusive property of NOMAD Gathering and its contractual partners, and these marks may not be used, copied or displayed by Visitors or third parties without the prior written consent of NOMAD Gathering or its contractual partners.
10.2. NOMAD Gathering is entitled to use the Visitor’s comments, suggestions and ideas relating to the Event without limitation and without any compensation.
11. FORCE MAJEURE
In the event of any unforeseeable and unavoidable obstacle (war, rebellion, strike, natural disaster, severe storm, epidemic, fire, etc.) as a result of which a party is unable to fulfil its contractual obligation and is not at fault, that party shall not be liable for any loss or damage resulting from such event.
If information from different sources contradict each other, the following order shall apply in determining the applicable regulations:
Primarily: the announcement(s) published by the Event organiser,
Secondly: the official House Rules of the Event
Thirdly: the information found on the entry tickets
Fourthly: the GTC
12. FINAL PROVISIONS
12.1. Csaba Klein, Sole Proprietor (Klein Csaba E.V.) is a sole proprietorship registered in Hungary with a Hungarian registered office, and its legal transactions are governed by Hungarian law.
In matters not regulated by this policy, the following are applicable: Act IV of 1959 on the Civil Code; Act CVIII of 2001 on certain issues of electronic commerce services and services related to the information society; Joint Decree 4/2009 (I.30.) NFGM‑SZMM on the detailed rules for indicating the selling price and unit price of products and the fee for services; Act LV of 2012; Act CLV of 1997 on consumer protection; Act CLXIV of 2005 on commerce; Act LXXVI of 2009 on the general rules for commencing and pursuing service activities; Government Decree 210/2009 (IX.29.) on the conditions for carrying out commercial activities; Act XLVII of 2008 on the prohibition of unfair commercial practices against consumers; Act XLVIII of 2008 on the basic conditions and certain limitations of economic advertising activities; as well as the provisions of Hungarian law in force at the time of the Event.
12.2. NOMAD Gathering is entitled to engage subcontractors and collaborators for any of its activities.
12.3. For matters relating to this GTC and the Event, and to the services provided by NOMAD Gathering, NOMAD Gathering and the Visitor stipulate the exclusive jurisdiction of the court of Budapest’s 11th District.
12.4. NOMAD Gathering employees receive questions, comments, ideas and any complaints relating to the Event at the Festival Centre operated at the Event venue, or via the email address nomadgathering.hun@gmail.com.
